The Brazilian Civil Code reform bill, recently submitted to the Senate, proposes structural changes that affect various areas of law—from inheritance and family law to digital rights and civil liability. In an interview with LexLegal Brasil, Caio Brandão Coelho Martins de Araujo, from Ciari Moreira Advogados, analyzed the implications of these changes and the challenges involved in modernizing the legislation.
According to Caio, the proposed repeal of Article 19 of the Internet Civil Framework could significantly change how digital platforms handle third-party content, raising debates around liability, freedom of expression, and the risk of private censorship. Additionally, changes in family law—such as removing the spouse from the category of mandatory heirs and assigning greater value to corporate shares in asset division—could redefine fundamental concepts of succession.
The reform represents an important step toward updating the Civil Code in light of social and technological transformations, but there is still a long road ahead in terms of legislative debate and refinement.
