Fonaje Statement 175: motivations, applications, and consequences

The recent approval of Statement 175 by the National Forum of Special Courts (Fonaje) introduced new guidelines for cases involving successive obligations in the Special Civil Courts. Lawyer Rafael Esteves Ventura, from Ciari Moreira Advogados, analyzed for Revista Consultor Jurídico (ConJur) the motivations and impacts of this change.
The statement establishes that the sum of twelve upcoming installments and any overdue installments cannot exceed the jurisdictional limit of the Special Courts. According to Rafael, the measure aims to prevent real estate claims from using the Special Civil Courts to circumvent procedural limits, but its application will depend on the judges’ adherence.
