The Brazilian National Civil Aviation Agency (ANAC) has definitively implemented SEI-ANAC as the official platform for the processing of administrative proceedings within the scope of civil aviation regulation. This measure consolidates the full digitalization of procedures before the Agency and renders the use of the system mandatory for filings, submissions, defenses, appeals, and all other institutional communications.

The adoption of SEI-ANAC represents not merely a technological upgrade, but a structural transformation in the manner in which airlines engage with the regulatory authority. As of its implementation, all procedural acts are carried out exclusively within an electronic environment, featuring automated deadline control, formal acknowledgment-of-receipt records, and continuous digital case processing.

Accordingly, the absence of proper registration, deficiencies in monitoring the platform, or failure to comply with electronic notices may result in significant consequences, including missed deadlines, the imposition of administrative penalties, and the aggravation of sanctions. Within the civil aviation regulatory framework, operational inaction is not construed as a mere technical failure, but rather as a breach of regulatory obligation.

Proper adherence to SEI-ANAC requires internal organization, the designation of responsible personnel for daily monitoring of publications, strict deadline management, and technical preparedness for the preparation of well-founded submissions. Companies that fail to structure this electronic case management workflow will be exposed to increased administrative and financial risks.

Furthermore, a company’s regulatory track record becomes readily traceable within the system, reinforcing the importance of a strategic, technical, and diligent approach in each initiated proceeding. The manner in which a company positions itself before ANAC directly impacts its institutional reputation and its exposure to enforcement measures.

In light of this framework, immediate compliance with the platform and the implementation of a preventive management model become indispensable measures to preserve operational regularity and the airline’s legal certainty.

Ciari Moreira stands ready to assist airlines in the implementation and strategic management of their SEI-ANAC proceedings, providing comprehensive support in deadline monitoring, preparation of defenses and appeals, structuring of internal workflows, and mitigation of regulatory risks.

Electronic compliance is no longer optional — it is a regulatory requirement. Adequate preparation today is what prevents material contingencies tomorrow.
